The ex-lawyer for the former president has left her position as New Jersey's top federal prosecutor. This comes after a court battle that challenged her right to occupy the role.

Official Departure

The nation's top law enforcement official, Pam Bondi, confirmed her stepping down on Monday. She commented that the judicial decision made it "untenable" for the official to effectively run her office.

"Do not interpret compliance for surrender," she wrote. "This battle will now reach across the nation."

Legal Background

The departure was triggered by a federal appellate panel ruled that she had been unlawfully serving as US attorney. This ruling is likely to affect scores of prosecutions in the Garden State.

The court said that a temporary posting that bypassed the advice and consent of the Senate violated the Federal Vacancies Reform Act.

It was also stated that Habba will continue working within the justice department as a senior adviser. She will pursue additional appeals of the ruling, in the hope of achieving a reversal.

In a statement, she argued that the court "should not be able to countermand the appointment of prosecutors entrusted with performing the primary duty of the administration of enforcing the law."

Before her appointment to the top New Jersey post, the former president had revealed he was naming her as his presidential counsellor in a potential future term, calling Habba as deeply loyal and a dedicated fighter for justice.
