Federal Court Mandates Freedom of Abrego Garcia from Immigration Detention

Courtroom scene

A court has ordered the prompt discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued detainment is without legal authority.

"Since his return from wrongful detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her ruling.

The case stems from a erroneous deportation to El Salvador earlier this year, which the government later acknowledged was an mistake. After his repatriation to the United States to answer human smuggling allegations, he was detained in immigration custody.

In her decision, the judge noted that the government does not have a valid removal order, which prevents them from deporting Mr. Abrego Garcia "for now."

Background of the Legal Challenge

The court proceedings center on disputed assertions. While the former administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he categorically denies this allegation.

He has also entered a not guilty plea to the conspiracy charges, which are part of a ongoing trial in Tennessee.

Conditions of Freedom

The judge, who was hearing his petition to deportation in a Maryland district court, determined that he must now adhere to the terms of his bond from custody in Tennessee. This decision effectively transfers his monitoring to the jurisdiction handling his criminal case.

This decision marks a notable development in a complex immigration battle featuring claims of mistaken imprisonment and disputed criminal associations.
